Welcome to Tumblewave. These Terms of Service govern your use of the Tumblewave website and your purchase of products through our online store. By using our website or placing an order, you agree to these Terms.

1. About Tumblewave

Tumblewave is a small jewelry brand creating handmade and small-batch jewelry inspired by the places, colors, textures, and landscapes that surround us.

Throughout these Terms, “Tumblewave,” “we,” “us,” and “our” refer to Tumblewave.

Our website and online store are operated through Shopify, which provides the ecommerce platform that allows us to sell our products to you.

2. Using Our Website

You agree to use our website only for lawful purposes and in a way that does not interfere with the operation or security of the website.

You may not use our website to:

Engage in fraudulent or unlawful activity
Attempt to gain unauthorized access to our website or systems
Interfere with the security or operation of our website
Copy, reproduce, or misuse our content, photography, branding, or product designs without permission

We reserve the right to refuse service or cancel an order when we reasonably believe our website or services are being misused.

3. Our Products

Tumblewave jewelry is handmade and/or produced in small batches. Because of the nature of handmade jewelry and the natural materials used in many of our pieces, individual pieces may vary slightly.

Natural stones, gemstones, minerals, dirt, mica, and other materials may have variations in:

Color
Pattern
Texture
Shape
Inclusions
Surface appearance

These variations are natural characteristics of the materials and are part of what makes each Tumblewave piece unique.

Product photographs are intended to represent the appearance of our products as accurately as possible. However, colors may appear slightly different depending on your device or screen.

4. Limited Batch Collections

Some Tumblewave pieces are produced as Limited Batch designs.

Limited Batch pieces are intentionally created in small quantities. Once a particular batch sells out, we may not reproduce the exact same design.

Availability of Limited Batch products is not guaranteed, and we reserve the right to discontinue or change designs at any time.

5. Product Availability

We reserve the right to limit quantities, discontinue products, or change product details and pricing at any time without notice.

We make every effort to keep product information and availability accurate. However, occasional errors may occur.

If we discover that an item you ordered is unavailable, we will contact you and provide an appropriate solution, including a refund when necessary.

6. Orders

When you place an order through our website, you are making an offer to purchase the products in your order.

After you place an order, you will receive an order confirmation by email. This confirmation does not necessarily mean that your order has been accepted. We reserve the right to refuse or cancel an order for reasons including:

Product availability
Pricing or product-description errors
Suspected fraudulent activity
Incorrect customer information
Other circumstances that prevent us from fulfilling the order

If we cancel an order after payment has been processed, you will receive a refund for the amount charged.

7. Prices and Payment

All prices displayed on our website are in U.S. dollars unless otherwise stated.

We reserve the right to change prices at any time. Price changes will not affect orders that have already been placed and accepted.

Applicable sales tax will be calculated and collected at checkout when required by law.

Payment must be successfully processed before an order can be fulfilled.

8. Shipping

Tumblewave currently ships within the United States only.

Orders are generally processed and prepared for shipment within 3–5 business days, Monday through Friday, excluding holidays.

We charge a flat-rate shipping fee of $5.95.

Once an order has shipped, most U.S. orders are expected to arrive within approximately 2–5 business days. Delivery estimates are not guaranteed and may be affected by carrier delays, weather, holidays, or other circumstances outside our control.

9. Shipping Problems

If your package arrives damaged, appears to be missing, or has been marked delivered but you cannot locate it, please contact us at info@tumblewavestudio.com as soon as possible.

For damaged packages, please provide photographs of the item and packaging when possible.

Once an order has been shipped, carrier delays and delivery issues may be outside of Tumblewave's control. We will do our best to assist you in resolving shipping issues.

10. Returns and Refunds

We want you to love your Tumblewave piece.

We accept eligible returns within 30 days of delivery.

To be eligible for a return, an item must:

Be unworn and unused
Be in its original condition
Include original packaging when applicable
Be returned within 30 days of delivery

To request a return, contact info@tumblewavestudio.com with your order number and the reason for the return. Please wait for return instructions before sending your item back.

Unless an item is defective, damaged, or incorrectly shipped, the customer is responsible for return shipping costs.

Approved refunds will be issued to the original payment method within approximately 5–10 business days after the returned item has been received and inspected. Your bank or credit-card company may require additional time to post the refund.

Original shipping charges are generally non-refundable.

Items That Cannot Be Returned

The following are final sale:

Custom or personalized pieces
Specially commissioned pieces
Sale items
Gift cards

We do not currently offer direct exchanges. If you would like a different item, you may return the eligible item and place a new order.

11. Damaged or Incorrect Items

If you receive an item that is damaged, defective, or different from what you ordered, please contact us at info@tumblewavestudio.com within 7 days of delivery.

Please include your order number and photographs of the item when possible.

We will work with you to correct the issue.

12. Intellectual Property

All content on the Tumblewave website—including photographs, product photography, written content, logos, branding, graphics, product names, designs, and other materials—is owned by or licensed to Tumblewave unless otherwise stated.

You may not reproduce, copy, modify, distribute, sell, or use our content for commercial purposes without our written permission.

13. Third-Party Services

Our website may use third-party services, including Shopify, payment processors, shipping providers, analytics services, and other tools that help us operate our business.

Your use of those services may also be subject to the terms and policies of those third parties.

Our store is hosted by Shopify. Shopify provides the ecommerce platform that allows us to sell our products and process transactions.

Our website may contain links to websites or services operated by third parties.

These links are provided for convenience. Tumblewave does not control and is not responsible for the content, policies, or practices of third-party websites.

15. Accuracy of Information

We make reasonable efforts to ensure that information on our website is accurate and current.

However, occasional errors may occur, including errors involving product descriptions, pricing, availability, photographs, or other information.

We reserve the right to correct errors and update information at any time.

If an error affects an order you have placed, we will contact you and provide an appropriate solution.

To the fullest extent permitted by applicable law, Tumblewave will not be responsible for indirect, incidental, special, or consequential damages arising from your use of our website or purchase or use of our products.

Nothing in these Terms limits liability that cannot legally be limited under applicable law.

You agree to indemnify and hold Tumblewave harmless from claims, damages, liabilities, and expenses arising from your violation of these Terms or your unlawful use of our website.

We may update these Terms of Service from time to time.

When changes are made, we will update the “Last updated” date at the top of this page. Your continued use of our website after changes are posted means that you accept the updated Terms.

These Terms of Service shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict-of-law principles.

Any dispute arising from these Terms or your use of our website will be handled in accordance with applicable Texas law.
